All products and services are subject to availability, applicable specifications, and the terms stated in the relevant quotation or sales agreement.

Product images are provided for illustrative purposes unless expressly identified as photographs of the actual unit being sold. Actual products may vary in color, appearance, condition, and configuration.

3. Product Condition and Specifications

Customers are responsible for reviewing product descriptions, specifications, condition details, and intended-use requirements before purchasing a container.

For used containers, ordinary wear, cosmetic imperfections, dents, surface rust, previous repairs, and other signs of use may be present. The extent of wear and the condition of each unit should be confirmed in the applicable product description, inspection report, or written quotation.

Customers should request clarification regarding any material specification or condition that is important to their intended use.

For refrigerated containers, customers should confirm the required temperature range, refrigeration equipment condition, electrical supply, operating requirements, and suitability for the intended cargo.

No container is represented as certified, food-grade, wind and watertight, suitable for international cargo transport, or capable of maintaining a particular temperature unless that status or capability is expressly confirmed in writing for the relevant unit.

4. Prices and Quotations

All prices are subject to confirmation and may vary according to container type, size, condition, quantity, availability, delivery destination, transportation costs, taxes, and other applicable charges.

Unless expressly stated otherwise in a written quotation, displayed prices do not necessarily include delivery, unloading, site preparation, applicable taxes, customs charges, permits, or other third-party fees.

Written quotations will specify the applicable price, included services, payment requirements, and any material conditions of sale.

A quotation is valid only for the period stated in the quotation. If no validity period is specified, please obtain confirmation that the quoted price and availability remain current before making payment.

An order is considered accepted when Titan Container Sales & Supply confirms acceptance in writing or enters into a written sales agreement with the customer.

5. Orders and Customer Information

Customers must provide accurate and complete information when requesting a quotation or placing an order.

This includes, where applicable:

• Full name or registered business name

• Billing and delivery addresses

For their protection, customers should independently verify any bank account details or changes to payment instructions using a previously verified company contact method before transferring funds.

An order may not be released for dispatch until the agreed payment conditions have been satisfied, unless different arrangements are expressly agreed in writing.

Any deposit, cancellation charge, or refund condition must be disclosed in the applicable sales agreement and will be subject to applicable law.

Titan Container Sales & Supply will not be responsible for payments sent to unauthorized third parties where the loss results from the customer’s failure to take reasonable verification steps, except to the extent liability cannot lawfully be excluded.

7. Shipping and Delivery

Delivery availability depends on the customer’s location, container availability, transportation arrangements, carrier schedules, site access, and other relevant circumstances.

Estimated delivery dates and transit times are estimates unless a delivery date is expressly guaranteed in writing.

Customers are responsible for providing accurate delivery details and ensuring that the delivery location is accessible and suitable for the agreed delivery vehicle and equipment.

Before delivery, customers should confirm that:

• The delivery route can accommodate the vehicle and container dimensions.

• The site has sufficient clearance and appropriate ground conditions.

• Required permits, access permissions, and placement approvals have been obtained.

• Suitable unloading equipment or lifting arrangements are available where required.

• A responsible person is available to receive the container, where applicable.

Unless expressly included in the written quotation, site preparation, cranes, forklifts, special lifting equipment, permits, and additional delivery attempts are not included in the container purchase price.

Additional costs arising from inaccurate delivery information, restricted access, failed delivery attempts, or customer-requested changes may be charged where disclosed in advance or otherwise permitted by applicable law and the sales agreement.

8. Inspection and Acceptance

Customers should inspect the container upon delivery, where reasonably possible, and promptly document any visible damage, missing items, or material discrepancy from the written order.

Any concern should be reported to Titan Container Sales & Supply as soon as reasonably practicable, with supporting photographs, delivery documentation, and a description of the issue.

Signing a delivery receipt or taking possession of a container does not waive any rights that cannot lawfully be waived, including applicable consumer rights or remedies for concealed defects, misrepresentation, or breach of contract.

Where a container is sold subject to a stated condition report or inspection record, that documentation forms part of the relevant sales information.

13. Limitation of Liability

To the extent permitted by applicable law, Titan Container Sales & Supply will not be liable for indirect, incidental, special, or consequential losses arising from the use, inability to use, delay in delivery, or purchase of a container, including loss of profits, business interruption, or loss of stored goods.

Nothing in these Terms and Conditions excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, death or personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded or limited.

Where legally permissible, our liability for a particular transaction will be limited in accordance with the applicable written sales agreement and relevant law.

Customers are responsible for safely securing, installing, maintaining, and using containers after delivery, subject to any obligations that remain with the seller or other responsible party under applicable law.

To the extent permitted by applicable law, customers are responsible for losses, claims, and reasonable costs arising from their unlawful use, unauthorized modification, negligent handling, or unsafe installation of a container, except to the extent caused by the acts or omissions of Titan Container Sales & Supply or another party for whom the customer is not legally responsible.

Nothing in this section removes any rights or responsibilities that cannot lawfully be excluded.

All website text, branding, graphics, logos, product descriptions, and other original website content owned by Titan Container Sales & Supply are protected by applicable intellectual property laws.
